  1. You and Us

1.1 We are Wells Shepherd Huts Limited (A company registered in England and Wales No:11891748 Vat No:318417407). Our registered office is Wells Shepherd Huts, Stydd Lodge Farm, Stydd Lane, Ribchester, Preston Lancashire, PR3 3YQ (“Wells Shepherd Huts, we, us, ourselves”).

1.2 You, the purchaser, are buying a product which has been designed and manufactured by Wells Shepherd Huts. When you place an order with us you are entering into a legally binding contract with us on the terms and conditions set out in this document (“you”) for the construction of your product.

2.2 When you place an order you will need to provide contact details so we can keep in touch with you through your build. These will be kept on file in accordance to GDPR standards.

3. Our Huts

3.1 Although our shepherd’s huts are designed according to traditional widths, we design our huts in a variety of different lengths and use a range of features to reflect your personal taste. This means that your hut can be very traditional or have a more modern theme throughout the hut (the “Hut”). We create shepherd’s hut solutions to a variety of different uses. On discussion on the size of your hut, we strongly recommend that you ensure that the hut can be delivered and maneuvered within the space you plan to place it.

3.2 . We aim to use only trusted FSC and PEFC. The structural timber used in the construction of our Huts is stress-graded framing timber.

3.3 In keeping with our commitment to quality all windows and doors and internal furniture used in the construction of our Huts are made using solid European oak.

4. Cooling Off Period

4.1 Once we have confirmed your hut specifications you have a cooling off period before we start the construction of your hut. You have a period of 14 days from once your initial deposit is received to cancel without penalty. We cannot start construction until the end of the cooling off period.

5. Purchasing your Shepherd’s Hut

5.1 Once we understand your requirements, we will supply you with a breakdown of the specifications of your shepherd’s hut, usually by email but can be provided by letter if requested.

5.2 You can change the specifications of your shepherd’s hut until the initial deposit is paid. After the cooling off period ends, mentioned in section 4, there may be an additional cost to any changes made to the design.

5.3 Once you have placed your order you will be required to pay an initial deposit. The full breakdown of the payment schedule can be found in Section 6 – Payment. This will start the cooling off period described in section 4. Once the cooling off period has passed, we will start construction on your shepherd hut and our contract will come into force. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you can request a refund without giving any reason for doing so, provided you give us notice to cancel within 14 calendar days after your order has been placed. We will refund any money received as soon as reasonably possible and in any event within 14 days of receiving your written notice of cancellation. Once construction of your Hut has begun, we are unable to provide a refund.

6. Payment

6.1 Once you’re happy with the design of the shepherd’s hut and you agree to our quote we require an initial deposit to be paid. This will be followed by the cooling off period of 14 days before we can start construction. Within this cooling off period, you may request a refund for any reason. After these 14 days we cannot provide a refund.

6.2 The initial deposit is 50% of any final cost.

6.3 Halfway through the build we will contact you to update you with how your shepherd hut’s is progressing. Once we are at this stage, you will be required to pay 25% of the remaining cost.

6.4 On completion, you will be required to pay the final 25%, along with any additional extras as well as delivery and siting costs. This payment must be paid before delivery can be arranged.

7. Delivery

7.1 You will receive updates on the progress of your hut. We will contact you towards the completion of your hut to arrange a convenient delivery time for you.

7.2 Please take into consideration where you would like the shepherd’s hut situated as it is your responsibility to ensure that there is enough space for the hut to be delivered. We recommend that there is sufficient additional space for the hut to be delivered and maneuvered into place. This should include all access areas to your chosen destination. Prior to the start date of your Shepherd’s hut build a site visit will be conducted in the initial stages. It is your responsibility to provide an even base for the hut.

7.3 If you know that access will be a problem please discuss this with us at the initial stage before the initial deposit has been paid and the build has begun as we will always try to find a solution wherever possible. If on arrival the access is not adequate, we will assess the options but reserve the right to charge you for any additional work required to situate your hut.

7.4 We cannot accept responsibility for late delivery if you delay making the final payment. We always strive to deliver it in a timely fashion once full payment is received.

7.5 We do not supply or install bases for our Huts.

7.6 Despite our best efforts to deliver your Hut to you in a prompt and safe manner, there may be unforeseen damage caused to your Hut by hazards beyond our control during transit and delivery, such as low hanging branches or inadequate clearance. Should any damage be caused to your Hut because of this, we can plan for repairs to be carried out on site.

7.7 We are not responsible for any damage to your Hut that results from insufficient access to the delivery address and as a result you may be charged for any repairs required. We will make you aware of this before any such repairs are carried out.

7.8 While our huts can accommodate electricity and plumbing, you are responsible for making sure that these services can be connected at your choose site. We recommend that you use a certified professional for this work and to test any existing provisions beforehand.

8. Guarantee

8.1 We guarantee that your Hut will be free from structural defects for a period of 15 years from the date of delivery. If any structural failure should occur to your Hut during this period, we will carry out the required repair works free of charge.

8.2 This guarantee does not extend to any exposed timber, paint work, cladding or non-structural component comprising any part of the Hut.

8.3 This guarantee does not extend to any damage resulting from neglect, failure to carry out routine maintenance and upkeep, improper use, adverse weather, exposure to corrosive materials, fair wear and tear, or damage caused by a third party.

8.4 There is a manufacturer’s warranty on items such as, but not exclusive to, third party fixtures of 12 months from installation to your shepherd hut. This could include sinks, taps, appliances and heating. As we do not manufacture these items ourselves, the extended warranty that we provide for our craftsmanship on the hut does not apply.

9. Price and Payment

9.1 The price of your Hut will be agreed before your hut construction begins. This is to make sure that the specifications of the Hut meet your requirements.

9.2 All prices given and delivery services are subject to the applicable rate of UK VAT.

9.3 Once your specifications for your hut have been agreed we will provide you with a quote. Any changes to this specification may result in a change in cost and you will be provided with a new quote. Once you have agreed you will need to pay an initial deposit and you will enter into the 14 day cooling off period before we can start construction.

9.4 Your hut will begin construction after you have agreed to the terms and conditions, the overall cost, the initial deposit has been paid and the cooling off period has passed.

9.5 Any changes requested during the build stage can incur additional costs. You will be notified of the cost before we start any additional work.

9.6 Full payment must be received before delivery.

9.7 We accept payment via BACS or cheque. Any payment made by cheque will be subject to the amount clearing into our account before being deemed as received.

10. Additional Terms and Liabilitiies

10.1 We are responsible for any foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for any loss or damage you suffer that is a foreseeable result of our breaking of this agreement or our failing to use reasonable care and skill. We will not be responsible for any losses suffered by you beyond the value of the Hut.

10.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products and for defective products under the Consumer Protection Act 1987.

10.3 We are not liable for any indirect losses or business losses. If you use the products for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

10.4 We will not be in breach of these terms nor liable for any delay in performing, or failure to perform, any of our obligations under these terms if such delay or failure results from events, circumstances or causes beyond our reasonable control.

10.5 If any provision or part-provision of these terms becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these terms.

10.6 Any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms or its subject matter shall be governed by and construed in accordance with the law of England and Wales.

10.7 Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms or its subject matter or formation.
